Key Judicial Developments of the Week In India

1. Himachal Ecological Crisis: Expressing concern over ecological damage in Himachal Pradesh, the Supreme Court on September 23 sought comprehensive reports on zoning violations, deforestation, and hydropower projects. The bench stressed that unregulated development is worsening landslides and climate vulnerability in hill states.

2. Firecracker Manufacturing in Delhi-NCR: The Supreme Court on September 26 permitted limited manufacturing of “green firecrackers” but maintained its ban on their sale in Delhi-NCR. Court allowed manufacturers with valid certification from the National Environmental Engineering Research Institute (NEERI) and the Petroleum and Explosives Safety Organisation (PESO) to continue production.

3. 1984 Riots: The Supreme Court on September 25 asked why the Delhi High Court overturned Congress leader Sajjan Kumar’s acquittal in the 1984 anti-Sikh riots case. Court called for a compilation on what led to reversal of acquittal. The matter will now be heard on November 12, 2025.

4. Tirupati Laddu probe: The Supreme Court on September 26 stayed the order of the High Court wherein it said the CBI had acted in violation of the top court’s directions while carrying out a probe into "adulterated ghee" being used to prepare the Tirupati Laddu prasadam. Court said, "Can't' CBI delegate some of its functions to another officer, can't it ask someone else to investigate...".

5. Hindu Society: While examining the challenge to provisions of the Hindu Succession Act, 1956, the Supreme Court called for caution while dealing with the structure of Hindu Society.  “Do not demean the structure of the Hindu society, court told the parties. The issue before the court is that of a woman’s husband’s family being given priority over her own parents and siblings in inheritance matters if she dies intestate.

6. Permanent Commission for SSC Women Officers: The Supreme Court on September 25 reserved its judgment on the plea alleging discrimination in grant of permanent commission to women short-service commission officers (SSCO). The central government, however, argued that there is no discrimination and soldier who is to defend the motherland has to be the most appropriate one, a separate process for women ends at recruitment. "We have to choose best possible talent in each batch," it said.

7. Delhi Riots Bail Pleas: The Supreme Court on September 22 issued notice on bail pleas of Umar Khalid, Sharjeel Imam, and others in the 2020 Delhi riots conspiracy case under UAPA. All five UAPA Accused have filed a Special Leave petition (SLP) before the Apex Court challenging the Delhi High Court's September 2 order denying bail to them. The matter will be next heard on October 7.

8. X Corp's challenge to Sahyog Portal: The Karnataka High Court on September 24, 2025, dismissed a petition filed by X Corp challenging the Centre’s powers to block online content under Section 79(3)(b) of the Information Technology Act, 2000. The High Court on July 29 had concluded the hearing in X Corp's plea.

9. Karnataka Caste Survey: The Karnataka High Court refused to halt the controversial caste survey, allowing it to continue while stressing participation must be voluntary. A batch of petitions had challenged the validity of Karnataka's caste survey, officially termed the Socio-Economic and Educational Survey, alleging that it is Siddaramaiah government's caste census in disguise.

10. Illegal Muslim marriage: The Allahabad High Court on September 23  declared an interfaith couple's marriage illegal under Muslim law after it found that the woman’s alleged religious conversion certificate was forged. Court said that if a conversion is invalid, then even under the customary Muslim law, the couple's marriage would be illegal.

11. Remarks on Judiciary: Advocate Shashi Ranjan Kumar Singh has formally requested the Attorney General of India (AGI) R. Venkataramani to allow criminal contempt proceedings against Sanjeev Sanyal, Member of the Economic Advisory Council to the Prime Minister (EAC-PM), over his recent remarks on the judiciary. Sanyal had said that the judiciary in the present state is the biggest roadblock to Viksit Bharat 2047.
