Allahabad HC directs Lucknow varsity to ensure security for student accused of derogatory video on Ambedkar

Court directed the Commissioner of Police, Lucknow, to ensure full security for the suspended LLB student during the university’s disciplinary proceedings

The Allahabad High Court at Lucknow Bench has directed the Commissioner of Police, Lucknow, to ensure the personal safety of a law student accused of circulating a video allegedly containing derogatory remarks against Dr. B.R. Ambedkar, after it was claimed the student was unable to participate in a disciplinary inquiry due to fear.

Justice Pankaj Bhatia was hearing a writ petition filed by Yasharth Rai, a fourth-semester LLB (Hons.) student, challenging the university’s February 13 suspension order. The order had not only suspended him but also barred him from entering the campus, pending an inquiry by the university’s Proctorial Board.

According to the petitioner, the allegations that he had made a video viral insulting Dr. Ambedkar were false. His counsel contended that despite the suspension, no final decision had been taken by the Proctorial Board, leaving his academic future uncertain.

Appearing for the university, counsel informed the court that the petitioner had been repeatedly called to appear before the Board but had failed to do so, possibly out of fear of backlash. The counsel assured that if the student appeared, the Proctorial Board would conclude the proceedings at the earliest. 

Taking note of the submissions, the High Court disposed of the petition with directions to facilitate the inquiry process while ensuring the petitioner’s safety. Justice Bhatia permitted the student to appear before the Proctorial Board within one week and directed the Board to decide his case within two weeks thereafter, following due process.

“The Proctorial Board shall ensure that the petitioner is granted full security and no harm is caused to him. If need be, the Commissioner of Police, Lucknow shall also ensure that proper safety/security is accorded,” the court ordered.

Court further clarified that the petitioner would have the liberty to challenge the Proctorial Board’s decision before the High Court if it turned out to be adverse.
