Allahabad High Court Grants bail to man arrested for alleged offensive tweet against Hindu women's modesty

It was argued that Saif did not intend to insult any community or religion and his tweet was only in reply to certain very offensive and instigating tweets against a particular community.

The Allahabad High Court recently granted bail to one Mohd. Saif Ali languishing in jail since June 6, 2022. Saif was booked under Sections 153-A, 295-A, 505(2), 509, 420 IPC and Section 66 of I.T. Act, 2000 for his tweet against Hindu women. 

Allegations in the First Information Report were that Saif had tweeted offensive language against the modesty of Hindu women. However, seeking Saif's bail, his counsel argued that Saif had tweeted in reply to some very offensive and instigating tweets that were tweeted against a particular community.

The counsel further contended that Saif had not made the aforesaid tweet intentionally to hurt any community and he was falsely implicated in the present case due to ulterior motives.

Furthermore, he argued that since Saif had not tweeted against any particular community or religion, hence, Section 153-A I.P.C. was not made out against him. 

Therefore, assuring the court that if released, Saif will not misuse the liberty of bail and co-operate in the trial, his counsel prayed for bail to be granted. 

The bench of Justice Deepak Verma considered the entire facts and circumstances of the case and opined that a case for bail was made out. 

Accordingly, keeping in view the nature of offence, evidence, complicity of accused and without expressing any opinion on the merits of the case, and further relying on the mandate laid down by Apex Court in the case of Dataram Singh Vs. State of U.P. and another (2018), Court ordered Saif to be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
