Bombay HC Directs Inquiry Officer To File Interim Report In Alleged Misuse Of 12 Gardens Allotted By Civic Body

The case pertains to the PIL filed after a complaint was made that there was a misuse of 12 gardens allotted by the BMC

The Division Bench of Chief Justice Dipankar Datta and Justice Madhav Jamdar on Thursday directed the Deputy Superintendent to file an interim report in a complaint alleging misuse of gardens by a licensee allotted by the Brihanmumbai Municipal Corporation (BMC).

A Public Interest Litigation highlighting the issue was filed in High Court after a complaint was placed with BMC about the misuse of gardens by the allottee.

The counsel appearing for the BMC informed the court that an inquiry officer was appointed and that a report will be submitted by him in 120 days 

The court took note of the inquiry officer that was appointed by the BMC. However, the court took objection to the four months period for an inquiry to be completed. 

The court in its order stated that
"We are view that 4 months is too long but as per submission of the counsel 4 months will be required" 

The court directed the officer to file an interim report after two months and noted that it is desirable that inquiry in at least six gardens out of twelve is completed along with recommendations and future course of action.
