'Come through proper channel': Allahabad High Court refuses to take suo moto cognizance of Advocate's alleged thrashing, death threat by local goons

The advocate, along with other members of the High Court Bar Association, mentioned the incident before the court and prayed that he be given security keeping in view the death threats extended by the goons.

The Allahabad High Court on Tuesday refused to take suo moto cognizance of an incident where a practicing advocate was allegedly thrashed by local goons after he tried to rescue a family from their attack on his way back home from Court.

The advocate, along with other members of the High Court Bar Association, mentioned the incident before the court and prayed that he be given security keeping in view the death threats extended by the goons.

However, the Court said that it could not issue a writ of mandamus or any other direction, as sought by the advocates, on just oral submissions of the victim advocate. Court pointed out that the other parties, the alleged miscreants, were not before it to present their case.

Therefore, Court asked the advocate to come through the proper channel for the relief sought. Court remarked, "We should not say this, but we often hear such incidents where lawyers are involved and sometimes it comes to light later that the events were exaggerated or the fuss was made out of nothing."

As per the First Information Report, on Monday, July 11, Advocate Prem Prakash Yadav was returning home from the Court and at around 5:30 pm he saw 4 persons attacking a man. When he tried to interfere and stop them, the attackers started beating him mercilessly.

The FIR further stated that when hearing the noises, the crowd gathered, attackers ran away in a Fortuner car extending death threats to the advocate.

Having apprehension of a threat to his safety, the advocate had appeared before the court seeking security.
