“Conduct Of Performing Nikahnama Totally Disgraceful” Bar Council of Delhi Temporarily Suspends Advocate’s License For Performing Religious Conversion
Bar Council of Delhi today has suspended temporarily, the license of a lawyer for allegedly using his chamber for performing religious conversion and Muslim Marriages (nikah).
In its three page letter written by the Chairman and Senior Advocate Ramesh Gupta have stated that, “Alleged activities are not permission nor are part of professional activities of an advocate and your conduct in performing a Nikahnama/Marriage Certificate is totally disgraceful and negates the dignity of the legal profession.”
“Considering the gravity of the issue and to uphold the dignity and integrity honor of the legal fraternity, I deem it fit to exercise the special powers conferred under Rule 43 of the Bar Council of India Rules and Section 6(1)(d) of the Advocates Act, 1961 while referring the issue to the Special Disciplinary Committee, as an interim measure, deems it appropriate to suspend his license to practice until the findings and conclusion by the Disciplinary Committee,” the letter states.
A three member Special Disciplinary Committee comprising Sh Himal Akhtar (Vice Chairman, Bar Council of Delhi), Sh KC Mittal (Former Chairman & Member, Bar Council of Delhi), Ajayinder Sangwan (Former Hony. Secretary & Member, Bar Council of Delhi) has also been constituted to immediately investigate the entire matter to save the dignity and credibility of the institution.
The Chairman has also directed the Advocate to file his response before the Special Disciplinary Committee within 7 days of receipt of the notice and to appear in person before the committee on July 16, 2021 at 4:00 PM in the office of Bar Council of Delhi failing which the Special Disciplinary Committee shall proceed ex parte and further take appropriate direction.
Senior Advocate Ramesh Gupta has also requested the Hon’ble Registrar of Delhi High Court, District Judge and DCP, Delhi Police of the concerned area to provide all necessary information and extend all support to the Committee.
In its three page letter, Chairman of Bar Council of Delhi has also requested the District Judge (incharge), Karkardooma Court to seal the same and to immediately stop the illegal activities.
“The Committee will conduct enquiry and will take decision as soon as possible, preferably within 3 months,” letter states.
