Delhi Court Grants Bail To ASI in Bribery Case After Complainant Retracts Allegations

A Delhi Court has granted bail to an assistant sub-inspector (ASI) accused of collecting bribes from transporters in exchange for not challaning their vehicles for traffic violations, after the main complainant retracted his allegations.
Special Judge Atul Krishna Agrawal of Rouse Avenue Court while allowing the bail application of ASI Vijay Kumar on June 12, observed that the complainant, Dilip Kumar, withdrew his initial allegations in a statement made before a magistrate.
The Court further held that the bribe amount had already been recovered and the custodial interrogation of the accused was no longer required.
“Considering the period of judicial custody of the accused as well as the fact that the recovery whatsoever has already been effected and co-accused Head Constable Surender has already been enlarged on bail … accused Vijay Kumar is admitted to bail,” the order stated.
According to the initial complaint, Dilip Kumar, who had been a helper with the Delhi Traffic Police for nearly two years, alleged that ASI Vijay Kumar was using him to collect payments from transporters in return for ignoring violations. He later turned hostile and described the case as “false and frivolous.”
The defence argued that the bribe story was a fabrication and a result of a monetary dispute, adding that the ASI was in jail since May 21 and nothing incriminating was recovered from him.
The prosecutor, however, opposed the application, insisting that the allegations were serious in nature and that bribe collection from transporters to avoid or minimize penalties undermined the fairness of the legal process.
