Delhi HC Bars 15 Outlets from Infringing Domino’s Trademark, Says It Can Risk Public Health

The defendants’ marks are deceptively similar and phonetically identical to Domino’s, Court prima facie noted;

The Delhi High Court has granted an ad-interim injunction restraining 15 local pizzerias from using deceptively similar names to the global food chain Domino’s Pizza.

The order was passed by a bench led by Justice Saurabh Banerjee, wherein the judge acknowledged concerns over potential public health risks and held, "Any confusion between such products, if allowed to continue, can lead to disastrous consequences on human health. Therefore, this Court has to adopt a more cautious and stringent approach..."

Domino’s Pizza, a Delaware-based corporation, had approached the high court seeking a permanent injunction against 15 defendants using deceptively similar marks like Domnic’s Pizza, Domnik Pizza, Daminic Pizza, etc.

It had sought damages for trademark infringement, passing off, dilution, and tarnishment of the Domino’s brand.

Before the High Court, the plaintiff, Domino’s contended that its trademarks are well-known globally, with over 21,000 stores across 90+ countries.

It was argued that the marks used by the defendants are phonetically and visually identical to Domino’s former trade name, Dominick’s Pizza. It also contended that the defendants operate on Zomato and Swiggy under these confusingly similar names to ride on Domino’s goodwill and mislead consumers.

Taking note of the submissions, the court directed Zomato and Swiggy (Defendants 16 & 17) to de-list and take down the impugned restaurants from their platforms.

High Court said, "It is prima facie evident that the marks of the defendants are deceptively similar and phonetically identical to the plaintiff’s trade name ‘Dominick’s Pizza’."

The matter is next listed for hearing on September 17, 2025.
