Delhi HC Issues Notice in Karisma Kapoor Children’s Suit, Asks Priya Kapur to Disclose Sunjay Kapur’s Assets

Delhi HC asks Sunjay Kapur’s third wife, Priya Kapur, to disclose all assets in plea filed by Karisma Kapoor’s children seeking a share in father’s estate.

The Delhi High Court on Wednesday issued notice on a plea filed by Bollywood actor Karisma Kapoor’s children, who are seeking a share in the Rs 30,000 estate of their father, late industrialist Sunjay Kapur.

Justice Jyoti Singh asked Defendant No. 1, Priya Kapur, Sunjay Kapur’s third wife, to disclose a complete list of all movable and immovable assets known to her.

In its order, the court recorded, “The plaintiff has instituted the present suit. Summons accepted. As agreed, written statements shall be filed within two weeks from today. Replication, if any, shall be filed within one week thereafter. List the matter before the Joint Registrar for further proceedings.

Issue notice. Notice accepted. Replies shall be filed within two weeks, with rejoinder, if any, to be filed within one week thereafter. Along with the replies, Defendant No. 1 shall file a list of all movable and immovable assets known to Defendant No. 1."

During the course of proceedings, Senior Advocate Mahesh Jethmalani, appearing for the plaintiffs, submitted that the will left behind by Sunjay Kapur was unregistered and completely excluded his children. He argued that the plaintiffs, comprising a 20-year-old daughter and a son, were seeking partition of their late father’s estate. Notably, Kapur had passed away during a polo match.

Senior Advocate Rajiv Nayar, appearing for Priya Kapur, conceded that the will was not registered, but maintained that assets worth Rs 1,900 crore had already been transmitted to the plaintiffs."Assets worth Rs 1,900 crores were conveyed just five days before the filing of the suit. Suddenly, after this transfer, the tone changed, and a suit was filed claiming, ‘I didn’t receive anything from my ex-husband.’Where were you then?” Nayar submitted.

At this point, Justice Jyoti said, "Mr. Nayar, just as we do in every case, I will register this plaint as far as Section 391 is concerned. I will issue notice, I will await the reply, and keep it back for two weeks. I will consider what needs to be done after I have examined what both parties have to say in writing. In the meantime, bring the will in a sealed cover."

However, Senior Advocate Vaibhav Gaggar, appearing on behalf of the deceased’s mother, Rani Kapur, strongly contested the will, stating, "I am 80 years old, and I am being forced to litigate. I was excluded from there. Everything was my legacy, which came from my husband back in 2015 by virtue of a will, to which Sanjay Kapoor and the two daughters had given their no-objection in my favour: my properties, my estate. And today, I have nothing. Yet everyone here is saying there is nothing suspicious about it. Then Ms. Priya comes in, now part of the family because she is married in. And within three months of her getting married. I have been left with nothing."

Meanwhile, Senior Advocate Akhil Sibal, appearing for Priya Kapur's six-year-old child, defended the will. He argued that there was nothing amiss here, adding that the will had been prepared in February and duly executed before witnesses in March, countering suggestions that it was created after Sunjay Kapur’s death.

The matter will now be taken up for further hearing on October 9 at 2:30 PM.

Notably, Karisma Kapoor married Sunjay Kapur in 2003. The couple had two children: daughter Samaira, born in 2005, and son Kiaan, born in 2011. Their marriage ended after 13 years, with a mutual consent divorce in 2016, under which Karisma retained custody of the children. The children, represented through their mother, have sought partition of the estate, rendition of accounts, and a permanent injunction against the defendants.

According to the suit, the defendants include Priya Kapur, her minor son Azarius, Sunjay’s mother Rani Kapur, and the purported executor of the will, Shradha Suri Marwah. It alleges that the children were excluded from the estate. The suit adds that Priya initially denied the existence of any will and claimed that all assets were held in the R.K. Family Trust. Later, however, she produced a will dated March 21, 2025, which allegedly bequeaths Sunjay Kapur’s entire personal estate to her.

The said will is now the centre of the controversy. The children contend that Priya, along with associates Dinesh Agarwal and Nitin Sharma, deliberately suppressed the will for over seven weeks before revealing it at a family meeting on July 30, 2025. Calling the will “forged and fabricated”, the suit highlights several suspicious circumstances: the original has not been shown to them, nor has any copy been provided. The children contend before the court that Priya is attempting to “usurp full control” of the estate to the exclusion of other legal heirs.

In their plea, the children have maintained that they shared a cordial relationship with their father and that he had assured them of their financial security. They claim that Sunjay had initiated ventures in their names, acquired assets for their benefit, and named them as beneficiaries. The children have therefore asked the court to declare them Class I heirs and to award each a one-fifth share in the estate.

As interim relief, they have sought freezing of all personal assets belonging to Sunjay Kapur until the matter is resolved.

Sunjay Kapur died suddenly on June 12, 2025, after collapsing during a polo match in England. While reports initially suggested he suffered an anaphylactic shock after swallowing a bee, the coroner ruled his death a natural one arising from underlying heart disease. As far as Karisma Kapoor is concerned, reports have revealed that she has no claim in the will.
