Delhi High Court Quashes FIR After Settlement, Orders Accused to Pay ₹25,000 to Arya Kanya Sadan

The Delhi High Court has quashed an FIR registered for offences of voluntarily causing hurt and criminal intimidation after the parties reached an amicable settlement, while directing the accused to contribute Rs 25,000 to Arya Kanya Sadan, a home for destitute girls.

A bench led by Justice Amit Mahajan was hearing a plea seeking the quashing of the FIR registered at Police Station Tilak Nagar under Sections 324 and 506 IPC.

According to the case, the accused had allegedly stabbed the complainant following an argument over the delay in delivery of a dry-cleaned blanket. However, the parties later executed a settlement agreement dated 13 November 2025, stating that they no longer wished to pursue the matter.

Taking note of the victim’s statement that he had no grievance left against the petitioner, the Court observed that continuation of proceedings would serve no purpose.

“In the peculiar circumstances of this case, it is unlikely that the present FIR will result in a conviction when Respondent No. 2 does not wish to pursue the case. In such circumstances, continuance of the proceedings would only cause harassment and heartburn amongst the parties,” the Court noted.

Finding the dispute to be private in nature and already resolved, the Court exercised its inherent power under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), corresponding to erstwhile Section 482 CrPC.

However, Justice Mahajan held that since the State machinery had already been engaged, the petitioner must bear costs.

“FIR No. 836/2023 and all consequential proceedings arising therefrom are quashed, subject to payment of cost of ₹25,000… to be deposited with Arya Kanya Sadan, 1488 Pataudi House, Daryaganj, New Delhi for the benefit of destitute girls,” the Court ordered.

The Court directed the accused to pay ₹25,000 compensation to the complainant within four weeks and submit proof to the concerned SHO.
