Delhi HC Seeks Police Response On AAP Worker’s Plea Alleging Assault By Parvesh Verma During Road Inspection

The Delhi High Court on Thursday sought a response from the Delhi Police on a plea filed by Aam Aadmi Party (AAP) worker Sahib Singh, who has alleged that he was assaulted by Delhi minister Parvesh Verma and persons accompanying him during an inspection of road construction work in West Delhi on September 27.
Justice Sachin Datta issued notice on the plea and directed the Delhi Police to file a status report. The matter has been listed for further hearing on November 17.
During the hearing, counsel appearing for the respondents questioned the maintainability of the petition.
Singh has approached the High Court seeking protection for himself and his family, preservation of CCTV footage and other electronic material, and an independent investigation into his allegations of assault, threats and police inaction.
According to the petition, Singh was accompanying Tilak Nagar MLA Jarnail Singh during an inspection of road construction work along the Outer Ring Road. The inspection was reportedly being carried out in connection with allegations concerning the quality of the construction and use of substandard material.
Singh claims that he was recording the proceedings on his mobile phone when Verma allegedly became agitated over questions relating to the road work and allegations of corruption.
The petitioner has alleged that Verma slapped, abused and threatened him during the incident. He has further alleged that persons accompanying Verma surrounded and assaulted him and that an unidentified individual struck him in his private parts.
Singh has also alleged that his mobile phone, which contained recordings of the incident, was forcibly taken and damaged.
The plea also raises allegations about the conduct of police personnel present at the spot. According to Singh, a member of Verma's security team pushed him and helped Verma leave the location, while local police personnel allegedly failed to intervene.
AAP worker alleges police complaint did not cover entire incident
Following the alleged incident, Singh approached the SHO of Vikas Puri Police Station and submitted a written complaint. An NCR was subsequently registered under Section 115(2) of the Bharatiya Nyaya Sanhita.
Singh has, however, claimed before the High Court that the NCR does not encompass the entirety of the allegations raised by him.
He also claims to have approached the Commissioner of Police on September 29, seeking registration of an FIR, legal action and protection.
The petition alleges that Singh began receiving abusive and threatening calls and messages from different numbers and social-media accounts after the incident and his complaints to the police. He has claimed that his private mobile number was circulated and that the threats were also directed towards his family.
On this basis, Singh has sought protection for himself and his family as well as a cyber-forensic examination to determine the source and identity of those allegedly responsible for the threats.
Plea seeks preservation of CCTV, electronic evidence
Singh has also sought directions for preservation of CCTV footage and other electronic evidence concerning the incident. The petition seeks preservation of such material from the relevant locations for the period between September 25 and September 30, apprehending that the recordings could otherwise be overwritten or lost.
The petitioner has furher sought an independent investigation into his allegations against Verma, his associates and the police personnel whose conduct has been questioned.
He has proposed that the investigation be entrusted to an independent team or agency not connected with the police personnel against whom allegations have been made.
In addition, Singh has sought constitution of an independent, judicially supervised inquiry committee headed by a former High Court judge. According to the plea, the proposed committee should examine the allegations, CCTV footage, electronic evidence and police records and submit a time-bound report to the High Court.
