Delhi HC To Hear PIL Seeking NIA Probe Into NEET Protest, Alleges Political And Foreign-Funded Nexus Behind 'Sansad Chalo' March

The matter was mentioned before the Bench of Chief Justice DK Upadhyaya and Justice Tejas Karia by Advocate Barun Sinha, appearing for the petitioner, Satish Kumar Aggarwal, former Vice President of the Akhil Bharat Hindu Mahasabha, who urged that the petition be taken up on an urgent basis.

During the mentioning, Sinha submitted that the "so-called student agitation" had made the "entire Delhi hostage" and that the road blockades in the national capital had caused immense hardship to the public.

Accepting the request, the High Court agreed to list the petition for hearing on Friday, i.e. July 24. 

According to the plea, the petitioner has approached the High Court in his capacity as a citizen and voter, alleging that what began as protests over the alleged NEET paper leak and the demand for the resignation of the Union Education Minister subsequently transformed into a politically influenced agitation involving activists, political leaders and allegedly foreign-funded organisations.

The petition states that the first protest was organised at Jantar Mantar on June 6, 2026, following which demonstrations continued. It alleges that Sonam Wangchuk later joined the agitation and commenced a hunger strike. The plea further refers to publicly available material regarding Wangchuk's alleged associations with certain foreign organisations and funding institutions, contending that these aspects warrant investigation by the competent authorities.

The petition also refers to proceedings concerning Wangchuk's health, following which he was admitted to Safdarjung Hospital for medical examination and treatment.

Referring to the events of July 20, 2026, the plea alleges that a pre-planned "Sansad Chalo" march was organised from Jantar Mantar towards Parliament over the alleged NEET paper leak and the demand for the resignation of the Union Education Minister.

According to the petitioner, leaders and members of various political parties, including the Aam Aadmi Party (AAP), Samajwadi Party and Azad Samaj Party, participated in and influenced the protest, thereby converting what was projected as a student demonstration into a political agitation.

The plea further alleges that the protest resulted in obstruction of public movement, including an ambulance, vandalism of public and private property, assaults on journalists, attempts to breach security arrangements near Parliament House, and injuries to police personnel and administrative officials. It states that these allegations are supported by newspaper reports annexed to the petition.

The petitioner contends that the cumulative circumstances, including the alleged involvement of activists, political leaders and foreign-funded organisations, raise serious concerns regarding the true nature and objectives of the protest and warrant a comprehensive investigation to determine whether any organised or external elements were involved in activities prejudicial to public order, national security, and the sovereignty and integrity of India.

The petition also relies on an advisory issued by the National Testing Agency (NTA), warning that submission of fake or AI-generated OMR sheets for scrutiny could invite legal action. It further refers to public criticism by AAP National Convenor Arvind Kejriwal of the advisory.

The petitioner has sought directions for registration of an FIR, a thorough and impartial investigation into the incidents connected with the protests, and, if the competent authority finds sufficient material, further investigation by an appropriate specialised agency, including the National Investigation Agency.
