The Delhi High Court on Wednesday issued notice in a plea seeking direction to link Aadhaar with a person's moveable or immovable property documents.
A bench of Chief Justice Satish Chandra Sharma and Justice Subramoniam Prasad issued notice to the Ministry of Law, Ministry of Finance, Ministry of Rural Development, and Ministry of Housing & Urban Development.
The bench was hearing a plea filed by Advocate Ashwini Kumar Upadhyay seeking direction to link movable-immovable properties with the owner’s Aadhaar number. The petitioner claimed that by the implementation of the above, black money holders would be forced to declare their unaudited movable and unmovable properties and it will take years to generate that amount of Benami property again.
"Corruption is the source of Benami Transaction and Black Money generation. Corruption undermines democracy and rule of law, leads to violations of human rights, distorts markets, erodes the quality of life and allows organized crime like separatism, terrorism, naxalism, radicalism, gambling, smuggling, kidnapping, money laundering, extortion, and dowry and other threats to human security to flourish," the plea submitted.
It further submitted that India cannot move forward without clean and transparent governance, for which a corruption-free society is a basic requirement.
Furthermore, it stated that Aadhaar is helping in bringing about an irreversible change in people's interests and the Prime Minister has reiterated that Aadhaar will work as a big weapon in the fight against Benami property.
