Delhi High Court Protects Actor-MP Jaya Bachchan's Personality Rights

Delhi High Court Grants Relief to Jaya Bachchan, Affirms Her Personality Rights
The Delhi High Court on Monday passed an interim order protecting the personality rights of Bollywood actor and Rajya Sabha Member of Parliament from the Samajwadi Party, Jaya Bachchan.
Justice Manmeet Pritam Singh Arora said she would issue an injunction and a blocking order against certain websites allegedly misusing Bachchan’s name and image.
The Court recorded the plaintiff’s submission that within one week, an amended memo of parties will be filed to include the concerned websites and their corresponding domain name registrars as parties. Upon the amended memo being filed, the Court directed that summons be issued.
The defendants in the case include Google, Amazon, eBay, and Facebook. Bachchan’s plea alleged that several websites, YouTube channels, and social media accounts were exploiting her name and persona for commercial gain.
During the proceedings, Senior Advocate Sandeep Sethi, appearing for Bachchan, submitted that the actor’s images were being morphed and circulated online, and that certain entities were commercially exploiting her likeness by selling unauthorised merchandise.
Sethi further argued that technological tools such as artificial intelligence were being used to create videos bearing a likeness to his client.
During the hearing, the Court observed that it was not inclined to pass a restraining order against a private entity selling posters of the 1973 film Abhimaan, featuring Jaya and Amitabh Bachchan, on Amazon.
Bachchan’s plea follows a series of similar orders recently passed by the Delhi High Court protecting the personality rights of her husband Amitabh Bachchan, son Abhishek Bachchan, and daughter-in-law Aishwarya Rai Bachchan.
