[Delhi Riots] "It is accepted that I was part of protest at Jafrabad": Gulfisha Fatima's counsel concludes arguments in bail plea before Delhi HC

Synopsis

Apart from Gulfisha's case, the same bench of the Delhi High Court is also to hear the bail appeals of other accused in the chargesheet filed by Delhi Police in the 2020 Delhi Riots larger conspiracy case.

Advocate Sushil Bajaj appearing for 2020 Delhi riots accused Gulfisha Fatima concluded his arguments in the plea challenging the trial court's order denying her bail in the case of criminal conspiracy. On Friday, the counsel stated that in Jafrabad, where some violence happened, it is accepted that Gulfisha was part of the protest there.

A bench of Justice Siddharth Mridul and Justice Rajnish Bhatnagar was hearing an appeal filed by the Delhi riots accused in the case of criminal conspiracy to orchestrate the riots of February 2020.

Bajaj submitted that Gulfisha had only created the WhatsApp group "Warriors" for the purpose of protest and there is nothing incriminating in that. Additionally, Bajaj argued,  "It has been alleged that I gave chili powder to the women, however, there was no recovery from me".

Fatima was arrested by the Delhi Police in April 2020 and was charged under the provisions of the Unlawful Activities (Prevention) Act (UAPA). A special court denied her bail on March 16, 2022.

While rejecting bail plea of Fatima, Additional Sessions Judge Amitabh Rawat had stated that the allegations against her were prima facie true & that there were reasonable grounds to reject her bail application.

The Court had found that Gulfisha was present in North East Delhi at the time of the riots and as per witness statements, she started the blockade and prompted attacks on police personnel and others with weapons like dande, Lal-mirch powder, and others in the Jafrabad area which had a "cascading effect leading to riots".
