[Draft] Victim declared dead on records appears in person; Delhi Court orders inquiry

;The Additional Session Judge of Patiala House Court was shocked to see the victim named Narender Kumar Singh Bisht in person before the court on 30th January who had allegedly died in a motor accident case.
The proocess Server Ct. Ashok Kumar Delhi Cantt. Claimed that the deceased’s father handed over the photocopy of his death certificate, meanwhile according to the victim present today before this court, his father Jaswant Singh died in 1998. As per the Court’s record the address and father’s name on the death certificate of the victim was same.
“A fraud was committed with the Court when the Death certificate of the victim was handed over to the Process Server” the Court observed.
The Additional Sessions Judge Harjyot Singh Bhalla observed, “that this matter requires inquiry and investigation as the death certificate of the victim was handed over by his father who according to the victim present before this court today died in the year 1998”.
The copy of this order, photocopy of death certificate, the report of the process server and the Aadhar card of the victim present today to be sent to the DCP who is concerned with this matter to hold an inquiry and direct an investigation if required, as directed by the Court.
The Court further directed that it may also be ascertained whether any MACT claim had been made by any person regarding the death of Narender Kumar (Victim) or his mother in this present case.
The Court further directed that the documents on record to be separately sealed and tagged with the file.
The Court has listed the matter for next hearing on 3rd March 2023.
