“Family should not suffer”: Delhi HC grants interim bail for 10 days to man for arranging daughter’s LLB course fee

Justice Talwant Singh of the Delhi High Court on Thursday granted interim bail for 10 days to a man for making arrangements to pay his daughter’s admission fees for LLB course.

Noting that "the family should not suffer" for the acts of the accused, the single-judge bench ordered,

 “Keeping in view the fact that the petitioner has to make arrangements for making payment of admission fees of his daughter and that the family should not suffer for his acts, I am inclined to grant him interim bail for a period of ten days from the date of his release, on the execution of personal bond of Rs.25,000 with one surety of the like amount”.

Justice single further made it clear that the accused’s interim bail will not be extended under any circumstance and that he will have surrender after the expiry of ten days.

The court was hearing a bail application filed by one Nihal Ahmed, who was charged with offences under Section 452 (House-trespass after preparation for hurt, assault or wrong­ful restraint), 325 (Punishment for voluntarily causing grievous hurt), 506 (Punishment for criminal intimidation) and 34 (common intention) of IPC, and Sections 25 (Punishment for offenses under the Arms Act), 27 (Punishment for using arms), 54 (Renewal of Arm's License), and 59 of the Arms Act.

Counsel for Ahmed contended that the last date of payment of admission fees for the LLB course by Ahmed's daughter had been extended to November 15, 2022. He further contended that Ahmed is in judicial custody for the last nine months and has to make arrangements for the payment of the same.

On the contrary, the Additional Public Prosecutor (APP) for the State opposed Ahmed’s request and argued that he is a proclaimed offender in the present case. He further contended that even after Ahmed's arrest, he was involved in another case.

Granting a 10-day interim bail to Ahmed, the single judge bench also directed the Jail Superintendent to submit a report in this regard. The court further ordered, “A copy of the order be sent to learned Trial Court as well as Jail Superintendent for information and compliance.”
