Kalyan Bainsla was arrested in Rajasthan after a 50-hour manhunt in the Gurugram woman biker hit and run case

Gurugram Police have arrested Kalyan Singh Bainsla, the car driver accused of hitting a woman sports bike rider on Golf Course Road, from Dausa, Rajasthan, on Tuesday, i.e. September 15.

The arrest came after police added Section 109 of the Bharatiya Nyaya Sanhita (BNS), relating to attempt to murder, to the case. The provision carries imprisonment of up to 10 years.

Gurugram Police Commissioner Sibash Kabiraj confirmed the arrest. DCP (East) Sandeep Kumar said three teams had been formed to trace Bainsla after he allegedly switched off his phone and went absconding following a media interview.

Police Add Attempt to murder, Stalking charges

The police had taken suo motu cognisance of a video posted by the woman, who identifies herself as Sia, on Instagram. The video showed a car swerving towards her motorcycle and hitting it on Golf Course Road.

Following the registration of an FIR at Sector 56 police station on Monday, police analysed the action camera footage and CCTV recordings. They subsequently added Section 109, Section 78 relating to stalking, and Section 79 relating to acts against the modesty of a woman through words or gestures, of the BNS.

The police are also recording Sia’s detailed statement as part of the investigation. Her family had submitted a written statement to the Station House Officer of Sector 56 police station.

Woman biker alleges driver chased her

In her Instagram video, Sia alleged that Bainsla had chased her while she was riding her Aprilia with a group of bikers. “He had started chasing me on the Golf Course Road. I asked him to drive while maintaining distance. He kept making gestures ordering me to stop my bike,” she said.

She also alleged that the driver appeared to be drunk and made indecent comments and gestures towards her.

The video, recorded by a camera mounted on her bike, appeared to show a Ciaz swerving towards her and hitting her motorcycle. Sia was thrown off the bike, while the motorcycle skidded for nearly 100 metres.

Sia later posted another video on Instagram responding to the claims made by the accused’s family.

Defence claims incident was an Accident

Advocate Naveen Bainsla, who is representing the accused’s family, denied the allegations and claimed that the incident was merely an accident.

“This is simply a case of an accident. They were riders, and they were provoking my friend. Sometimes, they would gesture as if asking him to race. When he increased the speed of the car slightly to move ahead, he lost control of the vehicle. A U-turn came ahead, and the car touched the bike. There is nothing more to the matter,” he said.

The defence has claimed that the riders were provoking Bainsla and that the contact between the car and motorcycle was accidental.

Accused allegedly trued to escape during custody

Police said Bainsla also attempted to escape after his arrest on the pretext of urinating. He allegedly fell during the escape bid and sustained minor injuries, following which he was provided first aid at a hospital.

Bainsla is a resident of Chandhat in Palwal district. Police said he runs a gym and works as a realtor. His cousin, Lavnish, was also arrested in connection with the incident.

Haryana Minister assures strict action

According to reports, Haryana Minister Gaurav Gautam assured that strict action would be taken against anyone found guilty in the case. “Whoever is found guilty will be apprehended. Whoever the culprit is, even if it happens to be from my own family, they too will be caught,” he said.

The investigation is continuing.
