"Hoping that at 'Teerthraj' hearts of two brothers will also meet like the three holy rivers': Allahabad High Court bats for amicable settlement in property dispute
On the last date of hearing, court had proposed that before coming to the merit of the case, both parties should be given a further chance to settle the issue amicably. When the brothers appeared before the court, court advised them to sit together like "Ram and Laxman".
The bench of Justice Saurabh Shyam Shamshery of Allahabad High Court recently expressed delight over two brothers' decision to agree on amicably settling a long pending family property dispute.
Justice Shamshery said, "The Court hopes that at Prayagraj, which is also called 'Teerthraj', the hearts of two brothers will meet like the three rivers (Ganga, Yamuna and Saraswati) meet at Sangam".
On the last date of hearing, Justice Shamshery had proposed giving a further chance to the parties to settle the issue, before coming to the merit of the case. The counsel for both parties had agreed to the proposal and the court had put up the matter on September 27 for further hearing. Court had also asked the two brothers to appear in person.
On September 27, when the matter was taken up at 2 PM, Sunil Gupta and his elder brother Vijay Gupta appeared before the court along with their sons. Court asked both the brothers to sit together at the Mediation Centre of the court and appear again at 4 PM.
The Court advised them to sit together like 'Ram and Laxman' and said, "...hope that they will appear before this Court at 04.00 PM like the said brothers and with a step taken forward together towards an amicable settlement".
At 4 PM, the hearing took place "in camera" and court appreciated the fact that both brothers come together "with smiling face and made a joint statement that they have moved a step forward to settle their dispute ignoring earlier counter allegations".
"Even their sons, who have spoken with each other after four years, are happy to know about their respective families and they also expressed that it is in the benefit of both families that disputes may be resolved," the court observed.
Thereafter, court heard both parties in person for about 15 minutes and noted that they principally agreed to the equal distribution of the family property and act in pursuance of it.
Asking both the parties to appear in person again on the next date of hearing, court posted the matter for further hearing on October 12, 2022.
