[Khwaja Yunus Custodial Death] Bombay HC Issues Notice In Plea Filed By Asiya Begum
In her plea, the mother of Khwaja Yunis, accused in the Ghatkopar Blast Case has stated that the acts of the judge amount to judicial indiscipline.
A Single Judge Bench Of the Bombay High Court on Monday issued notice in plea filed by Asiya Begum in Khwaja Yunis Custodial Death Case.
74-year-old Asiya Begum, mother of Khwaja Yunis has approached the Bombay High Court challenging the order passed by the Special Judge allowing the withdrawal application filed by the public prosecutor.
Khwaja Yunus was arrested with three others in the 2003 Ghatkopar bus blast case. Yunus had allegedly disappeared when he was taken to Aurangabad from Mumbai.
The withdrawal application was filed by the public prosecutor for four accused that were later charged for allegedly staging an encounter when they were taking Yunus to Aurangabad. The four accused are dismissed cop Sachin Waze, Rajendra Tiwari, Sun Desai, and Rajaram Nikam. The sessions judge allowed the withdrawal application last year.
Earlier the Sessions court and the Bombay High Court had observed that the custodial death of Yunus should be investigated after one of the co-accused had testified that he was tortured.
Asiya Begum in her plea has contended that Judge has caused grave injustice and has erred while allowing the withdrawal application.
