“Life is important to everybody, also to victim’s family”: Karnataka High Court denied bail in Murder case

While rejecting the bail of two brothers, the Karnataka High Court observed that “Life is important to everybody, not only to the accused but also to the victim’s family.”

Justice Natarajan of the Karnataka High Court observed that “Life is important to everybody, not only to the accused but also to the victim’s family.”

The court was hearing the bail application of two brothers, Sadik Khan and Adil Khan, who claimed that their father is in poor health due to 'bullous lung disease' and that there is no one to look after him, and 5-6 lakh rupees are required for his treatment.

Sadik and Adil were arrested in connection with the murder of Syed Afzal in February 2021. On the complaint of Afzal’s (deceased) brother, the duo was booked under Sections 341, 323, 143, 144, 148, and 302 read with Section 149 of the Indian Penal Code.

Earlier, their bail pleas were rejected by the Sessions court. Subsequently, the duo moved to the High Court alleging that all the other accused in the case had been granted bail, while they were in judicial custody for the past year.

While rejecting the bail of two brothers, Court held that when the petitioners have brutally murdered a person, they cannot seek bail to save the life of another person, i.e. the father. That apart, there are no additional grounds have been established for releasing them on bail.

The court also noted that the charge sheet stated that the accused attacked the deceased with knives and smashed his head with a stone, causing serious injuries.

The court ruled that simply stating that a sum of 5-6 lakh rupees is required is not sufficient grounds for granting bail.

Conclusively, Court held that the two had committed murder and taken the life of an innocent person. Life is important to everybody, not only to the accused but also to the victim’s family.
