NRI Neighbour's video on social media is defamatory, communally provocative: Salman Khan tells Bombay High Court

Synopsis

A single judge bench of the High Court was told that Kakkad in his defamatory videos has alleged Khan to be trying to usurp a Ganesha temple situated near his farmhouse in Panvel.

The Bombay High Court has been informed by Bollywood actor Salman Khan that the videos posted on social media by his Non-resident Indian (NRI) neighbour Ketan Kakkad are not only defamatory in nature, but also communally provocative.

An appeal has been filed by Khan against a city civil court order refusing to grant him relief in a defamation suit he had filed against Kakkad, his Panvel farmhouse neighbour.

The suit arose from an interview that Kakkad gave to a Youtube channel in which he had made certain allegations against Salman.

Senior Advocate Ravi Kadam argued before the High Court on Friday, August 12, that the civil court erred in its order refusing injunction.

The bench of Justice CV Bhadang was further told that the videos uploaded by Kakkad were blithely speculative as they were not only defamatory, but also communally provoked the viewers against Salman Khan.

'Kakkad has spoken about how Salman Khan, who is a member of a minority community, was trying to usurp a Ganesha temple situated near his farmhouse in Panvel', the High Court was told.

High Court was further told that Kakkad made several comments alleging that Salman Khan was a member of underworld don Dawood Ibrahim's gang and is running business of drug trafficking, organ trafficking and child trafficking from his farmhouse.

The matter has been posted for further hearing now on August 22, at 2.30 PM.

A Mumbai city civil court, in March this year, denied Khan interim relief in a defamation suit that he had filed against Kakkad for allegedly making derogatory remarks against him and his family over a land sale transaction.

Salman had sought directions from the court to stop Kakkad from making purportedly defamatory statements against him. 

The Additional Sessions Judge Anil H Laddhad pronounced the verdict on March 23, 2022.

Advocate Pradeep Gandhy, representing the actor, had stated before the ASJ that the defendants had made false, disparaging, and defamatory allegations in videos, posts, and tweets causing harm and loss to Khan, his family members, and his business ventures.

He had pointed out that Kakkad attempted to purchase a plot of land beside Khan’s farmhouse in Panvel, however, that transaction was canceled by the authorities on the ground that it was illegal.
