[Private Liquor Shops] Delhi High Court reserves order in PIL pertaining to AAP MLAs' allegations against CBI, ED officers

Synopsis

The PIL plea has been filed against the statement made by the Deputy Chief Minister of Delhi Manish Sisodia who alleged that the officers of CBI and ED were harassing the private liquor vendors to close their shops.

The Delhi High Court on Monday reserved order in the Public Interest Litigation plea filed over allegations made by Aam Admi Party MLAs alleging that the Central Bureau of Investigation and Enforcement directorate officers threatened private liquor shop owners to close their shops in Delhi.

The plea sought direction to the Central Bureau of Investigation and Enforcement Directorate to identify officers who allegedly threatened 176 private liquor vendors and forced them to close their shops.

A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad reserved order after hearing the arguments of both parties.

The plea had been filed in reference to the statement made by Manish Sisodiya, Deputy Chief Minister of Delhi alleging that the officers of Central Agencies like the CBI and the ED were harassing the private liquor vendors who were forced to close their shops.

The plea stated that either the Delhi Government/ Aam Admi Party MLA making allegations should produce proof to substantiate their allegations or publicly apologize.

The petitioner appearing in person Advocate Narinder Khanna stated that the plea had been filed to uphold the prestige of premier Central Agencies like CBI and ED that is being questioned and they have come under attack for allegedly being the cause of loss of livelihood of 176 private liquor vendors.

However, the counsel appearing for the Delhi Government submitted that the petition is frivolous and that heavy costs should be imposed upon the petitioner.

The plea sought the following directions:

  • to the Delhi Government to provide a list of 176 private liquor vendors who were harassed by officers of CBI and ED;
  • to CBI and ED to identify those officers who were causing harassment to 176 private liquor vendors and thereby forcing them to close their shops;
  • to CBI and ED to ensure facilities provided by private liquor vendors continue to be provided by Government Liquor shops from 1 September 2022;
