Terror Funding Case Delhi HC Dismisses Plea by Hizbul Mujahideen Chief’s Sons Against Framing of Charges

Court ruled that appeals challenging the framing of charges cannot be entertained under Section 21 of the NIA Act. A detailed judgment is awaited.

Delhi High Court holds appeals by Syed Salahuddin’s sons not maintainable under NIA Act and refuses to interfere with 2021 trial court order framing charges in terror funding case.

The Delhi High Court on Tuesday, December 23, 2025, dismissed appeals filed by Hizbul Mujahideen chief and proscribed terrorist Syed Salahuddin’s sons, Syed Ahmad Shakeel and Shahid Yousuf, along with other accused, challenging the framing of charges against them in a terror funding case.

A Division Bench of Justice Vivek Chaudhary and Justice Manoj Jain held that the appeals were not maintainable under Section 21 of the National Investigation Agency Act and therefore declined to interfere with the trial court’s order.

A detailed copy of the judgment is awaited.

The accused had approached the High Court against a 2021 trial court order by which charges were framed in the case.

According to the National Investigation Agency, the prosecution relates to the transfer of funds through hawala channels by Pakistan-based terrorists to Jammu and Kashmir as part of a criminal conspiracy involving operatives in India to finance secessionist and terrorist activities in the region.

Shahid Yousuf was arrested in the case on October 24, 2017, while Syed Ahmad Shakeel was taken into custody on August 30, 2018.

The agency has stated that Yousuf received funds from Hizb ul Mujahideen operatives abroad and was charge sheeted in 2018. The NIA has further alleged that Shakeel received money through Western Union from absconding accused Aijaz Ahmad Bhat and that his role also emerged in the raising and collection of funds from the terrorist organisation through cadres based in Saudi Arabia.

Earlier, on August 8, 2025, the Delhi High Court had granted bail to Syed Ahmad Shakeel but rejected the bail plea of Shahid Yousuf in the terror funding case.
