Supreme Court issues notice on plea filed by Alibaba Cloud challenging Madhya Pradesh HC order over their account seizure
The Supreme Court has today issued notice in a plea filed by Alibaba Cloud challenging the Madhya Pradesh High Court order rejecting the plea seeking restoration of account worth 55 crores seized by the Sessions Court.
A divisional bench of Justice A.M. Khanwilkar and Justice C.T. Ravikumar issued notice stating that we'll hear this.
Senior Advocate Gopal Subramanium appearing for Alibaba submitted that "I'm a Cloud-based service, I have have nothing to do with this matter, someone else has duped the money."
Subramanium further submitted, "I'm ready to submit 1 Crore rupees subject to the pendency of the matter, I don't' know how am I responsible for this, I have nothing to do with this, I just a cloud-based service, I'm an intermediary."
The matter pertains to an alleged fraud wherein, it is alleged that the accused has duped a person with Rs. 97 Lakhs and the said amount has been transferred to Chinese and Pakistani Citizens as cryptocurrencies. Wherein, while rejecting the interim relief sought by Alibaba the MP High Court had said that it appears that an international; Gang is operating to extort money from the people by cheating.
Subramaniam also informed the bench that I just host their domain name, like other companies like Google, Amazon, etc. do.
However, the MP High Court had rejected the interim relief stating that Alibaba was hosting these fake pages hence, has provided technical support to the accused.
