BJP Assam AI Video Row: Supreme Court to Hear Plea on ‘Muslim Takeover’ Content on Nov 25

The petition urges removal of an AI-generated video shared by BJP Assam’s official handle, alleging it spreads communal disinformation and violates the Election Code of Conduct 

The Supreme Court on Friday said it will hear on November 25 a plea seeking the removal of an AI-generated video posted on social media platform X by the BJP’s Assam unit, which allegedly depicts a communal narrative suggesting a Muslim takeover of the state if the party were to lose elections.

The matter was mentioned before the Bench of Justices Vikram Nath and Sandeep Mehta by Advocate Nizam Pasha, who sought urgent listing, noting that the Court had earlier issued notice in the case but it had not come up for hearing.

“Assam video matter... it didn’t come... please list. Notice was issued,” Pasha submitted.

Taking note of the submission, the Bench fixed the matter for November 25.

Notably, on October 7, the Court had issued notice on the application seeking the removal of an AI-generated video posted by the BJP Assam unit on X (Twitter), which allegedly portrays a “Muslim takeover” of the State if the party loses the upcoming elections. Pasha had submitted that the video, circulated ahead of elections, is intended to create communal apprehension by showing that if a certain political party does not come to power, a specific community will take over.

Filed in Writ Petition (No. 24/2022), the application highlights that the video, posted on September 15, 2025, depicts visibly Muslim individuals taking over Assam landmarks, including tea estates, Guwahati airport, Rang Ghar, and government lands. The petitioners through AoR Lzafeer Ahmad BF argued that the video vilifies Muslims, spreads communal discord, and undermines the secular values enshrined in the Constitution.

The petitioners have argued that the video, viewed over 4.6 million times and widely shared, vilifies Muslims and undermines the secular fabric of the Constitution. "It is pertinent to note that the aforementioned video was shared on the official X (twitter) handle of BJP-Assam viz. “BJP Assam Pradesh” on 15.09.2025 and as on 18.09.2025 (17:48 Hrs) it has been re-posted 6100 times; liked 19,000 times and viewed 4.6 million times. Thus, the same is required to be taken down immediately to contain any further spread of communal disharmony, unrest and enmity," it states.

It contends that as the ruling party, the BJP is constitutionally obligated to uphold secular values rather than circulate divisive propaganda.

"BJP-Assam is bound by the Constitution of India and thereby is bound to uphold the secular values that form part of the basic structure of the Constitution. However, the video circulated by its official twitter openly targets, vilifies and demonizes Muslims. The broad message of the video is that the worst fate that a State can be met with is its takeover by Muslims, and on the strength of the assurance that if the BJP is voted into power the State would be saved from the same, support is being sought," the plea reads.

"A State Government, elected and formed under the Constitution of India, is the guardian of all communities and is specifically prohibited by the Constitution from engaging in discrimination inter alia on the basis of religion, race, caste, gender, language. Thus, the burden of being fair, just and secular is far greater on an elected Government. In this regard it is pertinent to note that even private citizens are prohibited under law from making communal speeches or spreading communal disharmony," the plea adds.

The application seeks directions to X (Twitter) India Pvt. Ltd. and BJP Assam Pradesh to take down the video immediately to prevent further communal disharmony. It also urges the Court to initiate appropriate penal action against those responsible for the content.
