"Can't keep filing such petitions": Supreme Court in plea seeking independent probe into 2015 Rafale Deal

This is the third time ML Sharma has approached Supreme Court on the Rafale Deal issue. The first plea seeking enquiry into the Rafale Deal was rejected in December 2018 while the review petition was rejected in November 2019

Supreme Court today refused to hear the plea seeking an independent probe into the Rafale Deal of 2015 alleging that the Central Bureau of Investigation (CBI) has done a murky job and that an investigation is required to be conducted into that as well.

A bench of Chief Justice of India UU Lalit & Justice Ravindra Bhatt stated that they find no reason to entertain the present petition and that the petitioner cannot go around filing such petitions.

When the bench refused to entertain the plea in which Prime Minister of India Narendra Modi has been made a party, the petitioner ML Sharma said that there will come a time when people will become helpless. The bench did not budge from refusing to entertain the petition.

After some time, Sharma reappeared in court and sought withdrawal of plea. "At least I can go to the CBI," he said. The bench thus allowed him to withdraw the petition.

In his plea, Sharma cited the report by French tabloid Mediapart which stated that the aircraft manufacturer Dassault Aviation had paid 1 million Euros to a controversial middleman identified as Sushen Gupta.

Sharma has sought directions to quash the deal to procure 36 fighter jets from French company Dassault Aviation as an "outcome of corrupt and violation of Articles 13, 21, and 253 of the Constitution of India".

Earlier, on the same issue, the Supreme Court had observed that the review petition filed by Advocate Prashant Bhushan, Yashwant Sinha and Arun Shourie lacked merits.
