[Covid19] "Don't want to signal any doubt on vaccination”: Supreme Court refuses to issue notice in plea seeking investigation into ‘Adverse Effects’ from Immunisation

The Supreme Court on Friday refused to issue notice in a plea seeking direction to the Central Government, to keep records and investigate deaths owing to Adverse Effect from Immunisation (AEFI).

A division bench of Justice DY Chandrachud and Justice AS Bopanna noted after a person has taken the covid vaccine, every death cannot be said to occur due to the vaccination.

Bench has instead asked the counsel for the petitioner to serve a copy to the Solicitor General Tushar Mehta.

The petition has been filed by Ajay Kumar Gupta through Advocate Satya Mitra stating that there were allegedly 9000+ such deaths after taking vaccination across the Country.

Senior Advocate Colin Gonsalves appearing for Gupta submitted that ASHA workers can follow up with individuals who recently got the Covid-19 vaccine.

Gonsalves further argued that, “I don't wish to get into whether the vaccines are good or not, but COVID reactions need investigation, it needs to be seen whether the vaccine has any adverse effects."

Whereas, Justice Chandrachud while indicating his inclination towards not entertaining the petition said, "we cannot make policies on this, this is the biggest pandemic that we saw in our lifetime."

However, the Court while directing Gonsalves to serve a copy of the petition to the Solicitor General said that, “we have something in our mind, we'll take a call."
