[Khori Gaon Demolition] Supreme Court Extends Interim Protection from Further Demolition Given to the Illegal Construction by the Earlier Order

Though persisting to the earlier order for demolishing the illegal residential constructions in Lakkarpur Khori village in Aravali forest area, the Supreme Court today extended the interim protection given to the structures through the earlier order on August 3rd stating that the same protection will apply on all the connected matters in the case.

The Division Bench comprising Justice K.M. Khanwilker and Justice Dinesh Maheshwari held,

“In lieu of letter circulated by the Advocate on record for the State of Haryana, appointed by the Corporation, hearing is deferred till August 20. Interim arrangement in pursuance of 3rd August order will continue till next hearing.”

In its earlier order the Division Bench has directed that,

If it is not a forest land, the competent authority must abide by the protection given to the structures by this Court in the civil appeals referred to above, till Friday i.e., 6th August, 2021.”

The extension has been granted on the basis of the submission of the Solicitor General Tushar Mehta who requested for the some more time as the government is yet to receive the representation of the applicants in the matter to decide whether the illegal construction in the matter is on the forest land or not.

In its order of 3rd August, the bench has directed the,

“Applicants are free to present material/representation before the competent authority, who has issued notice for removal of allegedly unauthorized structures, by tomorrow i.e., 4th August, 2021 by 12.00 noon, which can be considered by the authority appropriately.”

Developments till date

On June 7, 2021 The Supreme Court has directed the State of Haryana to remove 10000 residential constructions that had come up at Lakkarpur-Khori village in Aravali forest area.

 However, in its order of 23rd Jule, 2021, the Supreme Court granted the Municipal Corporation Faridabad four weeks further time to demolish the illegal residential constructions that had come up in Lakkarpur Khori village in Aravali forest area.

Later, via its order dated August 3rd, 2021, the Supreme Court further ordered Faridabad Municipal Corporation post demolition of their illegal houses in the Lakkarpur Khori village in Aravali forest area, the Supreme Court today asked the Commissioner of the Corporation to consider setting up a back-up office in the Radha Soami complex where the concerned persons have been provided temporary food, shelter, and accommodation.

It the order of 3rd August, the Supreme Court also directed for the aforesaid protection.
