Supreme Court Defers Protest Pleas To October 15 Due To Justice Mohana’s Health
The pleas challenging police and paramilitary actions against protesters in Delhi was to be heard today, deferred on account of Justice Mohana's health.
Supreme Court to take up all protest related pleas’ on October 15 at a fixed time.
The Supreme Court has scheduled all pleas concerning protests for hearing on October 15, citing the health condition of Justice Mohana.
The matters, which were originally to be listed for consideration before the Court today, will now be taken up on the rescheduled date.
The pleas relate to protests in Delhi against Chief Election Commissioner Gyanesh Kumar and the Election Commission’s Special Intensive Revision (SIR) of electoral rolls. They also concern restrictions imposed on public transport ahead of the October 10 demonstrations, including the closure of metro stations and disruptions to train services.
The Court is also expected to consider pleas concerning alleged assaults on protesters and women journalists covering the demonstrations.
Today, the court also opined that it cannot ask Solicitor General Tushar Mehta to put in counters to every issue relating to the October 10 protests. Justice Bagchi said, "There are multiple matters, we cannot ask the SG to file counter in every case..there are overlapping issues.."
We would have heard it today if Justice Mohana was well, the CJI said.
"Your lordship must rest," SG Mehta told the bench in response.
Adding to the concern, Senior Advocate Gopal Sankaranarayanan said, "We have known your lordship from the Bar..her commitment is unparalled..".
Supreme Court will also be hearing the issue concerning detention of lawyers who took part in the protests concerning the SIR row on October 10, 2026.
Also, a contempt petition will be heard by Supreme Court alleging that the Central government has violated the court’s order to lift restrictions on metro and train services. The plea has named Union home secretary Govind Mohan, Delhi Police Commissioner Anurag Kumar, and Delhi Metro Rail Corporation (DMRC) chairperson D Thara as contemnors.
Bench: CJI Kant, Justice Bagchi and Justice Mohana
