Supreme Court grants anticipatory bail to MLA Jegan Moorthy in abduction case

Moorthy, if arrested, shall be released on the undertaking that he shall cooperate in the investigation and not threaten the witnesses or tamper evidence.;

The Supreme Court of India yesterday granted anticipatory bail to MLA M Jegan Moorthy, a Puthiya Bharatham Katchi leader, in an abduction case.

"...if the petitioner is arrested in connection with FIR No.101/2025 registered at PS – Thiruvalangadu (renumbered as C.R. No.1/2025), he shall be released on personal bond of Rs.25,000/-, subject to the undertaking that he shall cooperate in the investigation and will not threaten the witnesses or tamper the evidence", a bench of Justices Manoj Misra and NK Singh ordered.

Moorthy's counsel informed the bench that there was no dispute that the abductee was recovered and not from the possession or control of the applicant.

It was further submitted that Moorthy had been implicated for mala fide reasons by alleging that he had a hand in the abduction. the bench was further told that even assuming that the applicant interacted with one of the parties to the dispute, that may be considered for the purposes of settling the issue. 

Moorthy's counsel also contended that in any event no custodial interrogation was required.

Noting that the matter required consideration, the bench went on to issue notice in the appeal filed against the Madras High Court's decision denying the MLA any relief.

Recently, the supreme court also dealt with a controversy that arose after the Madras High Court, while hearing the anticipatory bail application of Moorthy, had directed the arrest of ADGP Jayaram in connection with the kidnapping case.

In a brief order, the Madras High Court had stated that two co-accused had made confession statements against the ADGP. Based on these revelations, the court held that action should be taken against him in a manner known to law.

On June 19th, the Supreme Court set aside the Madras High Court’s order to "secure and take action" against Tamil Nadu Additional Director General of Police (ADGP) HM Jayaram in connection with an alleged abduction case.

It further directed that the investigation be transferred to the Crime Branch–Criminal Investigation Department (CB-CID) and requested the Chief Justice of the Madras High Court to assign the case to a different bench.
