Supreme Court pauses demolitions at Bale Shah Peer Dargah, orders status quo
Allegedly, the Bale Shah Peer Charitable Trust has encroached upon protected mangrove belts located on government-owned land parcels.;
The Supreme Court of India has issued notice in the writ petition filed seeking protection from demolition /eviction from the Bale Shah Peer Dargah without following the due process of law by the government authorities.
A bench of CJI BR Gavai and Justice AG Masih has also directed status quo in relation to Dargah situated in Uttan, Mumbai.
The Revenue Minister of Maharashtra recently ordered demolition of illegally added portions on a land parcel measuring 1,290 square meters at the Bale Shah Peer Dargah in Uttan on or before May 20, 2025.
Following this, a notice dated May 15, 2025 was sent by the jurisdictional police authorities warning the trustees of the Dargah from creating any law and order situation once the process of demolition/eviction as declared by the state government is initiated.
Senior Advocate Vinay Navare, appearing for the Dargah Trust, informed the bench today of the revenue minister Chandrashekhar Bawankule's statement.
CJI Gavai led bench has granted stay of 4 weeks on the demolition orders.
