Timely intervention of Delhi Police could have saved girl: Plea in Supreme Court by father of murder victim

The Supreme Court is all set to hear the plea by the father of a girl who was murdered in Bihar, filed against the Commissioner of Police, Delhi alleging delay in action by the authorities.

Court was told that a complaint was lodged before the SHO, Sagarpur at Delhi on 16th June, 2022 alleging that the daughter of the petitioner, Shashi Saxena, had been abducted, but, no First Information Report was registered in spite of a cognizable offence having been made out.

"Counsel states that if timely action had been taken by the Delhi Police, perhaps the eventual murder of the daughter of the first petitioner would have been averted. Hence, he has requested this Court to further scrutinize the role of the Delhi Police so as to extract a degree of accountability.." a bench of Justices DY Chandrachud, Surya Kant and AS Bopanna noted.

In the case before court, the Superintendent of Police, Aurangabad, Bihar had filed a counter affidavit stating that on 25th May 2022, a dead body of an unknown woman was found within the jurisdiction of Madanpur Police Station, District Aurangabad. On the same day, a dead body of an unknown male was found in the jurisdiction of PS Amas, District Gaya.

As per the affidavit, Moni Saxena, the petitioner's daughter was allegedly murdered because she had accompanied one Anil Kumar Pandey, who had taken Rs.9,00,000/- (Nine Lacs) from one Abhimanyu Singh to ensure the job of his brother in the Armed Forces but Anil Kumar Pandey grabbed the amount which caused discontent in the mind of Abhimanyu Singh.

The affidavit added that Moni had abused and objected on the point of transaction of money, while she had accompanied Anil Kumar Pandey, who was also murdered.

Accused Abhimanyu Singh had confessed that he along with his associated, committed murder of Anil Kumar Pandey and Moni Saxena and the dead bodies were thrown in two different places having different police station jurisdiction to mislead the investigation.

Since none appeared on behalf of the Commissioner of Police and the Deputy Commissioner of Delhi Police, Vasant Vihar, after notice was issued in the matter on June 30th, the top court granted liberty to serve the Standing Counsel for the NCT of Delhi.

The matter is likely to come up for hearing after two days, i.e., on July 28, 2022.
