[Unnao Rape Case] Former BJP MLA Kuldeep Singh Sengar moves Delhi HC seeking 2-months' interim bail for daughter’s marriage

The bail plea filed by Sengar was listed before a High Court's division bench of Justices Siddharth Mridul and Talwant Singh, but Justice Mridul directed it to be listed for Thursday before another bench not comprising Justice Singh.

Former Bhartiya Janta Party (BJP) MLA Kuldeep Singh Sengar who has been sentenced to life imprisonment for raping a minor girl in Unnao District of Uttar Pradesh in 2017, moved the Delhi High Court on Monday seeking two months' interim bail for his daughter’s marriage.

The interim bail plea was listed before a division bench of Justice Siddharth Mridul and Justice Talwant Singh.

During the hearing, counsel for Sengar submitted that he seeks two months interim bail for attending his daughter’s marriage scheduled for February 8, 2023. He also submitted that the marriage ceremonies shall begin on January 18. Furthermore, he stated that Senior Advocate N. Hariharan will be leading Sengar’s case.

Taking note of the submissions, Justice Siddharth Mridul directed the matter to be listed before another bench on December 22.
“Let this application be listed before in which one of us, namely, Justice Talwant Singh is not a member subject to obtaining directions of the Chief Justice”, Justice Mridul ordered.

Sengar has challenged the Trial Court order dated December 20, 2019, wherein the Tis Hazari court judge sentenced him for the "remainder of his natural biological life for abducting and raping a minor girl.

Sengar was convicted under various provisions including Section 376 (2) of the Indian Penal Code which deals with a public servant who takes advantage of his official position and commits rape on a woman in his custody or in the custody of a public servant subordinate to him.
