Allahabad HC grants bail to man Jailed For 'Objectionable' Facebook Post on CM Yogi Adityanath

Synopsis

The accused was arrested in September last year and was in jail since then.

The Allahabad High Court recently granted bail to a man accused of uploading some objectionable material on his Facebook page with regard to Uttar Pradesh Chief Minister Yogi Adityanath.

The single judge bench of Justice Sameer Jain granted the relief in view of the accused’s period of incarceration and his clean criminal history.

 The judge also took into account the fact that all the alleged offences against the accused were triable by Magistrate First class.

Therefore, the single judge bench ruled in favour of the accused.

The accused namely Sajid @ Sajid Pardhan was booked under Sections 295A, 505 (2) of the Indian Penal Code and Section 67 of Information Technology Act at Dilari Police Station in Moradabad district of the State.

Seeking bail before the high court, Sajid’s counsel argued that Sajid was innocent and had been falsely implicated. He also submitted that Sajid had no criminal history to his credit.

Moreover, he argued that even if the allegations against Sajid were accepted, then also all the offences were triable by Magistrate First class and maximum punishment provided for the offences was three years.

Therefore, he urged before the court that Sajid was entitled to bail during pendency of the trial in the case.

Agreeing with the same, the single judge bench granted bail to Sajid without expressing any opinion on the merits of the case.

Court, however, imposed certain bail conditions which included that Sajid shall not induce, threaten or promise any person acquainted with the facts of the case so as to dissuade him from disclosing such facts.

Court also restrained Sajid from tampering with the evidence or indulge in any criminal and anti-social activity.

“In case of breach of any of the above conditions, the prosecution will be at liberty to move an application before this Court for cancellation of the bail of the applicant,” court ordered.
