[Bhima Koregaon Case] Bombay High Court Rejects Jyoti Jagtap's Bail Plea

Synopsis

Jyoti Jagtap's Bail appeal was rejected by the Division Bench after taking note of the fact that the prima facie case established by NIA, was true.

A Division Bench of the Bombay High Court comprising Justice A.S Gadkari and Justice Milind Jadhav, on Monday, rejected the bail plea filed by Jyoti Jagtap, who was arrested in the Bhima Koregaon Case. 

Jyoti Jagtap had filed an appeal against the Special Court's (NIA Court) order, rejecting her bail application. The Special Court rejected her bail application in February this year. 

The bench while rejecting Jyoti Jagtap's bail plea noted that the prima facie case established by the NIA was true. 

Jyoti Jagtap was alleged to be a member of a cultural group "Kabil Kala Manch" which organised Elgar Parishad in December 2017, which led to violence among groups. 

The case was being investigated by the Pune police and was later transferred to National Investigation Agency. 

The appeal filed by Jagtap was taken up by the High Court in September, where, the counsel representing Jagtap argued that she was falsely implicated in the case. The counsel also argued that she was not arrested for two years after filing of the FIR, and the Pune Police did not even file a charge sheet. Further, it was also argued that there was nothing placed on record to show that she was a part of the banned organization. 

On the other hand, the counsel representing NIA argued before the court that Jagtap was one of the main conspirators who triggered the violence, and that she was undergoing arms training. It was also submitted before the court that Jagtap was a member of the banned organization CPI, and that she was operating for CPI in the urban areas through Kabir Kala Manch.
