Bombay High Court Grants Interim Bail To Congress MP's Son Booked in Hit & Run Case

The Bombay High Court has ordered the interim release of Congress Rajya Sabha MP Chandrakhant Handore’s son, Ganesh Handore, who was arrested by the police in a hit-and-run case.

A division bench of the high court, comprising Justice Revati Mohite Dere and Justice PK Chavan, was hearing a plea filed by Handore challenging his arrest.

Ganesh Handore was arrested in connection with a hit-and-run incident in Chembur, where one person was critically injured.

Ganesh’s counsel submitted that he was initially charged with bailable offences, but later, non-bailable offences were added.

The counsel further argued that Section 110 of the BNSS would not be applicable in this case, as Ganesh was not under the influence of alcohol at the time of the incident.

Ganesh Handore challenged his arrest and sought to quash the FIR lodged against him, claiming that he was wrongfully detained. He also requested interim release while his petition challenging the arrest was pending.

The division bench noted that Ganesh was initially charged only with rash and negligent driving, but later, the non-bailable offence of attempt to commit culpable homicide was added.

The bench observed that this was a classic case of rash and negligent driving, especially as Ganesh was not intoxicated at the time. It questioned the police's decision to add such serious sections in an accident case, describing it as a misuse of legal provisions.

As a result, the bench directed Ganesh's immediate release from jail, pending the hearing of his petition.
