The plea sought direction to grant an extension of 2 years period for the deregistration of Advocate's old personal vehicles in view of the restrictions on registration of Diesel Vehicles more than 10 years old and Petrol Vehicles more than 15 years old in compliance with the orders in the matter of Vardhman Kaushik Vs. Union of India & Ors.
The Delhi High Court on Tuesday dismissed a Public Interest Litigation plea seeking direction granting an extension of 2 years period for deregistration of the Advocate's old personal vehicles.
A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad dismissed the plea stating, "There is an order of the National Green Tribunal and the Supreme Court and still you want us to consider this?"
The plea filed by Advocate Rakesh Sachdeva had submitted that the Advocates practicing in Delhi had a tough time due to Covid-19. Since March 2020 as the Courts were not operating for about 2 years and due to restrictions on the movement of the vehicles, Advocates did not use their vehicles for about 2 years, the plea added.
The relief has been sought in view of the restrictions on registration of Diesel Vehicles more than 10 years old and Petrol Vehicles more than 15 years old in compliance with the orders in the matter of Vardhman Kaushik Vs. Union of India & Ors.
The plea submitted that the "lawyers community was badly affected financially due to Covid-19 and were even seeking financial help from the Bar Council of Delhi as well as Bar Associations in the Saket, Patiala House, Tis Hazari, Dwarka, Karkardooma and Rohini, etc. Court Complex."
Whereas the extension of time by two years shall be of great help for lawyers in movement from their homes/offices to various courts otherwise they shall face great hardships, the plea added.
