The plea has been filed against the cap imposed by the Delhi Government on number of applications for the old age pension scheme
The Delhi High Court on Friday issued notice on a plea against a notification of the Delhi Government stating that any new application under the Old Age Pension Scheme shall be received within an overall ceiling applicable. It is alleged in the plea that this excluding hundreds of needy senior citizens.
A bench of the Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad pointed out, "How can there be a cap on the number of applications?," while allowing time to the Delhi Government to seek instructions on the issue
The plea has been filed by one Dharam Chand Arora, a senior citizen aged 77, through Advocate Rahul Sagar Sahay and Advocate Raghav Rajmalani.
Advocate Sahay argued that a ceiling cap of number of pensions to be given at a time has been imposed by the Delhi Government, which is arbitrary.
The plea has further submitted that the impugned notification does not provide any mechanism as to how the prospective applicants will become aware when there is a vacancy available or when should they apply/reapply.
It has been alleged, "No number seems to be allotted to the applications received and there seems to be no waiting list for the applicants. Thus, the implementation of the ceiling limits completely remains non-transparent, arbitrary and discriminatory, open to rampant abuse."
