The Election Commission has prohibited both the groups from using the party name 'Shiv Sena', and the party symbol. Further has directed them to choose an alternative name, and symbols for the upcoming bye-elections.
The Election Commission of India, in an interim order, in the petition filed by Current Chief Minister, Eknath Shinde, against the former Chief Minister, Uddhav Thackeray, under Election Symbols (Reservation & Allotment) Order, 1968, prohibited both the groups to use the party name "Shiv Sena", and the symbol "Bow & Arrow", reserved for Shiv Sena.
However, the Commission allowed both the parties to use any such name with a linkage to the parent party Shiv Sena. Further, both groups are allowed to choose any three symbols from the list of free symbols notified by the Election Commission for the current bye-election.
Both the parties are directed to submit their names and symbols to the commission by 1:00 PM on 10th October.
The order of the Election Commission of India came after Eknath Shinde had approached the Election Commission with a plea to decide who the real Shiv Sena is. Earlier the Supreme Court had rejected the plea of Uddhav Thackeray led Shiv Sena to seek a stay on the proceedings of the Election Commission.
Eknath Shinde, leader of the Shiv Sena had rebelled against the former Chief Minister Uddhav Thackeray with 40 other MLA's which led to the fall of the Maha Vikas Aghadi (MVA) government. Eknath Shinde, is currently the Chief Minister of Maharashtra.
