The Court after taking note of the practice, which was carried out by the villagers and taking into consideration the stand of the government that animal sacrifice can be allowed but not grant permission to the petitioner for any kind of firing as a salutation, disposed of the petition.
A Division Bench of the Bombay High Court comprising of Justice S.V Gangapurwala and Justice R.N Laddha has disposed of a writ petition filed by Adhivasi Vikas Sanastha to allow animal sacrifice on the day of Dussehra after the State Government’s permission to allow the animal sacrifice.
The petition was filed stating that animal sacrifice was being carried out at Saptashrungi temple on the day of Dussehra by the people of the village. The said practice was being performed till 2017. The practice was discontinued after 2017 since a firing had taken place due to which 12 people were injured. After the incident, the Sub-Divisional Magistrate passed an order putting a ban on animal sacrifice.
The counsel of the petitioner argued before the court that such practice was being carried out since time immemorial and that there is a fear in the minds of the people of the village that if such practice is not carried out it will be a bad omen. The petitioner submitted that at the time of sacrifice the government may allow only 2 people from the administration, 2 from malkari, and 2 people from the trust. Further, the counsel stated that only one animal will be sacrificed.
The State government submitted before the court that the government will give permission for the animal sacrifice, however, the government will not grant permission to the petitioner for any kind of firing as a salutation which is part of the custom.
The court after accepting the government’s stand disposed of the writ petition.
