The Election Commission of India has informed the Bombay High Court that it will allow the whistle symbol to Bahujan Samaj Aghadi candidates for the upcoming Maharashtra assembly polls.
The vacation bench of the high court comprising Justice Arif Doctor and Justice Somshekhar Sundaresan was hearing a petition filed by Bahujan Samaj Aghadi (BSA)
The BSA filed a petition in the high court seeking immediate relief considering the election is around the corner.
In January this year, the Election Commission of India allotted the whistle symbol to Janta Dal United.
However, in a letter dated 3rd November 2024 addressed to the Election Commission of India, JDU informed that has decided not to contest the ensuing election in the State of Maharashtra and it was thus that the Janta Dal (United) was surrendering the symbol “Whistle” allotted to the Janta Dal (United)
Therefore, Advocate Akshay Shinde appearing for the ECI informed the bench that since BVA had applied for the said symbol “Whistle”, the same would be allotted to the BVA by following the procedure laid down in the requisite Rules/Guidelines.
The bench in its order stated that all rights and contentions of the parties in respect of any issues on law or otherwise are kept expressly open.
