'Highly objectionable', SC on petition seeking to know why Karnataka HC's Justice M Nagaprasanna recused from three cases

Synopsis

"Manner of filing this petition highly objectionable," Justice Oka remarked today

The Supreme Court of India today expressed its objection over a petition being filed seeking probe into recusal by Karnataka High Court's Justice M Nagaprasanna and laying down of guidelines on the process of recusal. 

Justice Nagaprasanna recused from three matters, one of them allegedly after having reserved orders in the matter.

A Justice AS Oka led bench found the petition to be inappropriate and capable of sending “wrong signals”.

"Look at your prayers...What is this? This will send wrong signals. Guidelines is fine but you can't seek a relief directing probe into under what circumstances judge recused, it will show some other motive is there..." Justice Abhay Oka further remarked.

Court further noted that the writ petition was filed in oblique manner and it was unsure of motivation behind it.

"We court cannot probe the discretion of the judge....", Court further said.

The bench went on to allow the withdrawal of the plea saying that it was not prima facie satisfied with the petitioners' case.
