Supreme Court expands remit of Union's 7-member expert committee to address concerns over NEET UG

Supreme Court of India has expanded the remit of the seven-member expert committee, chaired by Dr K Radhakrishnan, former Chairman, ISRO, constituted by the Union government to look into the concerns raised over conduction of NEET UG 2024 exams.

The remit of the Committee, in addition to the tasks that it has been entrusted with by the Union government and the NTA, shall encompass the following:
a. Examination Security and Administration
b. Data Security and Technological Enhancement
c. Policy and Stakeholder Engagement
d. Collaboration and International Cooperation
e. Support and Training

Noting that the Ministry of Education constituted the committee by a notification dated 22 June 2024 which stated that the report of the committee shall be submitted within two months from the date of the issue of the notification that would be 22 August 2024, the top court has ordered, "in view of the expanded remit of the committee in terms of this judgment, additional time may be required for a holistic report on various aspects related to the conduct of the NEET. Therefore, the report of the committee shall be submitted to the Ministry of Education by 30 September 2024".

The Ministry of Education has been directed to a decision on the recommendations made by the committee within a period of one month from receiving the report.

"It shall prepare and begin to implement a plan of action on this basis. The Ministry of Education shall report compliance with these directions within two weeks of taking the decision on the implementation of the recommendations", top court has added.

A CJI DY Chandrachud led bench of the Supreme Court of India yesterday said that no systemic breach occurred with the sanctity of the NEET UG 2024 examinations beyond the cities of Hazaribagh and Patna.

While holding so, court has also asked the National Testing Agency to make changes to the system as per the suggestions made by the high-powered committee constituted by the Education Ministry.

"NTA should avoid the flip flops that happened in this case...there was breach in one of the centers..all this should be taken care of..we have highlighted all the mistakes made by the NTA which the committee should address..", the bench also comprising Justices JB Pardiwala and Manoj Misra has ordered.

Solicitor General Tushar Mehta, who was present in court through video conferencing assured the bench of making sure that changes are made in letter and spirit.

Recently, Supreme Court of India had said that after considering the precedents before it and the materials submitted by the parties, it cannot hold that ordering cancellation of entire NEET UG 2024 exam would be justified.

"At the present stage, there is an absence of material sufficient to lead to the conclusion that the result of the examination stands vitiated or there was any systemic breach to the sanctity of the examination..", the bench held.
