[Yes Bank DHFL Loan Fraud Case] Medical Assistance Will Be Given But No Extra Privileges: Bombay High Court To Dheeraj Wadhawan

Wadhawan sought directions to be issued by the court for a post-discharge follow-up by the same doctor and also sought interim medical bail.

A single judge bench of the Bombay High Court comprising Justice Bharathi Dangre on Tuesday said that the DHFL promoter Dheeraj Wadhawan would get the necessary medical assistance but will not get any extra privileges.

"Necessary medical assistance you deserve you will get, but no extra privileges," the court said to counsel appearing for Wadhawan.

Wadhawan, an accused in the Yes Bank DHFL loan fraud case, was apprehended in April 2020 by the Central Bureau of Investigation.

On July 14, a Special PMLA Court dismissed Wadhawan's interim medical bail application and granted permission for his medical treatment at a private hospital.

During today's proceedings, Wadhawan's counsel conveyed to the bench that he was discharged from the hospital on August 1. Nonetheless, the discharge document indicated a scheduled follow-up after a week, which allegedly remained unattended. 

It was further contended that the doctor issued the discharge certificate under duress, and Wadhawan continued to experience several medical issues.

Wadhawan prayed before the court to issue directions for a post-discharge follow-up by the same doctor and also sought interim medical bail.

In response, the bench agreed and directed the doctors to conduct an examination of Wadhawan within the jail premises. If the doctor's assessment suggested that hospitalization was necessary, the court's permission would be sought for such a transfer.

During the hearing, the bench also told the counsel for Wadhwan that, "Health condition will be taken care of but don't make it ground that you have to be released," the bench said.

Meanwhile, the high court has directed the CBI to submit its response to the plea and scheduled the next hearing for September 11th.

The CBI's FIR alleges that Yes Bank sanctioned a loan of 3700 crore to Wadhwan, who then transferred kickbacks of 600 crores to companies owned by the daughters and wife of Yes Bank founder Rana Kapoor. Eventually, Kapoor himself is said to have received the 600 crore kickbacks.
