Key Judicial Developments of the Week In India
1. Waqf Amendment Act, 2025: Supreme Court on September 15 refused a full stay on the Act but halted key provisions (5-year Islam clause, collector’s powers) in order to protect the interests of all the parties and balance the equities. "Presumption is always in favour of the constitutionality of the statute", CJI Gavai said.
2. Vantara SIT clean-chit: The Supreme Court on September 15 noted that no contravention of law had been reported by the SIT appointed by it as against Vantara, and the complaints stood closed. Court said, “Allow good things to happen in the country”. Moreover, court has left it open to Vantara to pursue its remedies in accordance with law for the deletion of any offending publication or for any action against those responsible for the misinformation.

Fraudulent conversion laws: The Supreme Court, on September 16, granted four weeks to the states for filing their responses on various petitions challenging the constitutional validity of anti-religious conversion laws enacted by several states in the country. The laws have been made to keep a check on the mischief of religious conversion by misrepresentation, force, undue influence, coercion, allurement, or by any other fraudulent means.

6. Anand Karaj marriages: The Supreme Court has directed States and UTs to notify rules under the Anand Marriage Act, 1909 within four months and ensure interim registration of Anand Karaj marriages. Video with 65B Certificate: The Supreme Court on September 15 held that a compact disc is an electronic record and once the requirements under Section 65B of the Indian Evidence Act, 1872 are satisfied, such video evidence becomes admissible like a document. 9. Cruelty in Marriage: The Delhi High Court on September 16 held that a wife’s persistent and pressurising conduct to sever her husband’s bonds with his family amounts to cruelty, and therefore constitutes a valid ground for divorce under the Hindu Marriage Act, 1955.

Accused’s Caste in FIRs: The Allahabad High Court on September 16 issued sweeping directions to the Uttar Pradesh government to delete caste columns from FIRs, recovery memos, arrest forms, and other police documents. Court further recommended that the Union Government amend motor vehicle rules to ban caste slogans and identifiers on cars and strengthen digital media guidelines to curb caste-glorifying content on social media platforms.
