5A Delhi court on Friday granted anticipatory bail to Congress leader Jagdish Tytler in a case related to the Pul Bangash killings during the 1984 anti-Sikh riots.

Special Judge Vikas Dhull of Rouse Avenue Court granted the Congress leader pre-arrest bail on furnishing a bail bond of Rs. 1 lakh and a surety of like amount.

While granting anticipatory bail, the court also imposed certain conditions on Tytler, including that he will not tamper with the evidence in the case or leave the country without its permission.

The case pertains to the incident of killing of three people and a gurdwara was set ablaze in the Pul Bangash area on November 1, 1984, a day after the then prime minister Indira Gandhi was assassinated by her Sikh bodyguards.

Notably, on Wednesday, the judge had "reserved order" in the plea.

Tytler had sought anticipatory bail on Medical conditions, mental health issues, and his old age. He had approached the court on August 1.

On July 26, Additional Chief Metropolitan Magistrate (ACMM) Vidhi Gupta Anand had issued summons to Jagdish Tytler and directed him to appear before the court on August 5.

“I have gone through the supplementary chargesheet, case record, statement of eyewitnesses and other witnesses. There is sufficient material to proceed further”, the ACMM had said. She had further said, “I take cognizance of Section 148 , 153A and 188 of IPC”.

In May, the CBI filed a supplementary chargesheet against Tytler based on statements of new witnesses who claimed that they saw him allegedly instigating the mob which had assembled at Azad Market’s Pul Bangash Gurdwara on November 1, 1984, following which it was burnt down and three persons were killed. The chargesheet alleged that Tytler “incited, instigated and provoked” the mob, after which he had moved an anticipatory bail plea at Rouse Avenue Court on August 1.
