[2017 Rape Case] Delhi Court Orders Release Of Portuguese Accused Following HC’s Grant Of Bail

Synopsis

Jose Inacio Cota, a resident of Betalbatim and a Portuguese national, was apprehended by the Goa Police five years after the alleged rape of a woman at a pub in London. 

The Patiala House Court, on Friday, ordered the release of a Portuguese national implicated in an alleged rape case of 2017 following the High Court’s order granting him bail. Additional Chief Judicial Magistrate Abhishek Kumar after acknowledging the bail bond issued by the High Court, directed the release of the accused, Jose Inacio Cota. 

The bench of Justice Dinesh Kumar Sharma, through an order dated July 10 granted bail to the accused for six months.

Standing Counsel Ajay Digpaul, representing Union, noted that his extradition process to the United Kingdom was not feasible due to the pending criminal case against him in Goa. ‘In view of Section 31(d) of the Extradition Act, the extradition is not possible till the criminal case arising out of FIR No. 80/2021 under Sections 504/324 IPC registered at PS Maina Curtorim, Goa is not disposed of’, the Union asserted.

Furthermore, the government notified the High Court that Jose Inacio Cota may be granted bail until he was either acquitted or had completed his sentence.
