384 New Judicial Officer Posts Created For District Judiciary: State Government Tells Bombay High Court

The Maharashtra State Government has informed the Bombay High Court that it has created 384 new posts for judicial officers in the State of Maharashtra.

The Ministry of Law and Justice Department of the state government informed the division bench of the high court, comprising Justice Revati Mohite Dere and Justice Gauri Godse, that after the creation of 384 posts, the total number of posts had increased to 2360 from 2012.

The division bench was hearing a public interest litigation filed by Vaijnath Pandurang Vaze, who sought an increase in the strength of judges in Maharashtra and adequate court infrastructure for them.

Government Pleader PP Kakade informed the bench that the National Court Management Systems Committee (NCMSC) had recommended creating a total of 3211 posts for judges.

He informed the bench that the sub-committee of the high-power committee and the high-power committee have approved creating the remaining 2863 posts, and the same will be placed before the cabinet for approval.

During the previous hearing on December 1, the division bench headed by Justice Revati Mohite Dere observed that no real efforts were being made by the government, even after the 2018 judgment of Justice Abhay Oka directing the government to take steps to appoint judges on the district level.

The bench had asked the Principal Secretary, Finance Department, and the Deputy Secretary, Law and Judiciary Department, to be present before the court on December 1, after which the bench asked them to file a report.

Pursuant to the order of December 1, the Law Secretary of the Law and Judiciary Department filed a report on December 15, which, according to the bench, was not satisfactory. Therefore, it asked the Law Secretary to file a fresh report.

 After a fresh report was filed on December 19, stating that the government has created 384 new posts for judicial officers, the bench posted the matter to January 8, 2024.
