Advocate alleges humiliation and jail threat by judge in open court.

An Allahabad High Court advocate has sought the UP Advocate General’s consent under Section 15(1)(b) of the Contempt of Courts Act to initiate contempt proceedings against Justice J J Munir, alleging humiliation and a jail threat during a hearing.

An advocate practising at the Allahabad High Court has approached the Uttar Pradesh Advocate General seeking written consent to initiate contempt of court proceedings against Justice J J Munir, alleging that the judge humiliated him and threatened to send him to jail during court proceedings on October 9.

In an application under Section 15(1)(b) of the Contempt of Courts Act, 1971, Advocate Arun Mishra alleged that Justice Munir used harsh language against him after questioning him over his conduct during an earlier hearing on October 7.

According to the application, Mishra had appeared before Court No. 2 on October 7 to seek the tagging of Writ Petition No. 40824 of 2026 with a batch of petitions involving an identical issue. He claimed that the request was allowed and that he left the courtroom within 20 seconds.

Mishra alleged that when he appeared before the same court on October 9 in another matter, the senior judge questioned him about why he had allegedly misled the court during the earlier hearing. Court asked him that if the applicant had not filed a stay application, why he did not communicate the same to the bench.

The advocate claimed that he told the judge that he was not audible while dictating the order.

The application alleged that the judge then used harsh words and said, “I can send you behind the bar for six months.”

Mishra further alleged that the judge commented on his confidence level and referred to his engineering background while holding him responsible for the situation.

According to the application, the judge subsequently rose from the bench at around 11.30 am.

"...applicant humbly asked the Sr. Judge to kindly tell the applicant the degree of confidence to be shown while arguing a case; this led the Sr. Judge to loose his temper and then His Lordship made the engineering background of the applicant solely responsible for the entire cause. The Sr. Judge lost his temper and, as appeared, the blood pressure of His Lordship shot up, and the bench rose at around 11.30 a.m.," the application stated.

Court again assembled at 12.15 PM. The advocate stated that in the meantime, he received a call from the high court office asking him to affix a Rs 5 stamp on an application annexed to the earlier writ petition.

He claimed that he told the caller that he had not sought any interim order.

The application further alleged that, when the court reassembled, the judge again humiliated Mishra over his late entry into the legal profession. Mishra claimed that he told the judge that he would not have entered the profession had he known that advocates would be humiliated in this manner.

According to the application, Allahabad High Court Bar Association ex- president Rakesh Pandey subsequently entered the courtroom, following which the judge released the case.

Mishra alleged that the incident was not an isolated one and claimed that the judge routinely acted in a similar manner in open court.

He also stated that he had approached other advocates who were present during the incident, but they declined to support him because the matter concerned a sitting judge.

Seeking the Advocate General's written consent under Section 15(1)(b) of the Contempt of Courts Act, Mishra has requested that contempt proceedings be initiated against Justice Munir.
